1. Introduction

These Terms & Conditions apply to use of all Foundry Coffee Gift Cards.

In these Terms & Conditions: “Foundry Coffee”, "we" or "us" refers to Foundry Coffee Group Ltd, a company incorporated in England with company number 10795896 whose registered office is at Fordham, St Georges Lane, Hurstpierpoint, BN6 9QX. "you" refers to the purchaser &/or user of the Foundry Coffee Gift Card. 

Purchase &/or use of a Foundry Coffee Gift Card will constitute acceptance of these Terms & Conditions. Please read these carefully before using your Foundry Coffee Gift Card. If there is anything you do not understand, please contact us via email at hello@foundry.coffee.  

We recommend that you keep a copy of these Terms & Conditions for future reference. These Terms & Conditions are only available in English.

Foundry Coffee Gift Cards remain the property of Foundry Coffee Group Ltd. 

For Foundry Coffee Gift Cards purchased online at https://giftcards.foundry.coffee  (“Site”), additional Terms & Conditions relating to the sale of such Gift Cards apply at paragraph 13.

2. Using your Foundry Coffee Gift Card

You may use your Foundry Coffee Gift Card to purchase eligible items at any participating Foundry Coffee outlets in the UK. When you use your Foundry Coffee Gift Card the amount of your purchase will be deducted from the balance on the card. The remaining balance may be applied to future purchases. Change will not be given. If your purchase exceeds the balance on the Foundry Coffee Gift Card you must pay the excess by another payment method. 

You may check the balance on your Foundry Coffee Gift Card at any participating Foundry Coffee outlet. You may top up the balance on your Foundry Coffee Gift Card at any participating Foundry Coffee outlet. Foundry Coffee Gift Card balances cannot be used to purchase gift vouchers or additional gift cards. You may not exchange or redeem your Foundry Coffee Gift Card for cash. No change or refunds will be given where the sales transaction is for an amount less than the balance on the Foundry Coffee Gift Card. 

We reserve the right to refuse to accept damaged Foundry Coffee Gift Cards or any Foundry Coffee Gift Card which we believe has been stolen, duplicated, tampered with or is being used fraudulently or is otherwise suspected to be affected by fraud.  

One or more Foundry Coffee Gift Cards can be redeemed against a single order but no more than five.

3. Expiration & Cancellation

Your Foundry Coffee Gift Card & the balance on it will expire if the card is not used to make a purchase for 12 consecutive months. We reserve the right to cancel your Foundry Coffee Gift Card if we suspect it has been stolen, is being used fraudulently or in breach of these Terms & Conditions.

4. Loss, Theft, Damage

You should take care of your Foundry Coffee Gift Card & treat it like cash. Foundry Coffee is not responsible for lost or stolen cards. You should immediately report any loss, theft, fraudulent or unauthorised use of your Foundry Coffee Gift Card to Customer Services at hello@foundry.coffee.

If you lose your Foundry Coffee Gift Card or it is stolen or damaged, we may - at our sole discretion - issue a replacement Foundry Coffee Gift Card credited with the unused balance from your lost/stolen/damaged card. We will require your Foundry Coffee Gift Card number & proof of purchase before we can consider any request to replace your Foundry Coffee Gift Card. If you subsequently find or retrieve a Foundry Coffee Gift Card which you have reported lost or stolen, you must notify Customer Services immediately.

5. Foundry Coffee Loyalty Club

Purchases made with Foundry Coffee Gift Cards in participating Foundry Coffee outlets will be eligible to earn Foundry Coffee Loyalty points (via the Foundry Coffee Mobile App) on valid purchases if you are a registered Foundry Coffee Loyalty member. Please ensure that you scan your Foundry Coffee Mobile App in the usual way when you make your purchase. You cannot use Foundry Coffee loyalty points to purchase Foundry Coffee Gift Cards. You cannot earn Foundry Coffee loyalty points when you purchase a Foundry Coffee Gift Card.

6. Resale/Use in Promotions

You may only use your Foundry Coffee Gift Card for your personal non-commercial use. You may not sell your Foundry Coffee Gift Card. Foundry Coffee Gift Cards may not be used in sales or promotional activities including as giveaways or prizes in competitions without the prior consent of Foundry Coffee. Foundry Coffee reserves the right to cancel any Foundry Coffee Gift Card that it suspects has been resold or obtained in connection with an unauthorised sales or promotional activity.

7. Data Protection & Privacy

You may be asked to provide certain personal information, including your name, address & contact details. You agree that the information you provide to us will be true, accurate, current & complete in all respects. You also agree to notify us of any changes in this information. We are committed to maintaining the security of your personal information in accordance with the requirements of the Data Protection Act. All personal information you provide to us will be used in accordance with our Privacy Policy.

8. Liability of Foundry Coffee  

Foundry Coffee shall not be liable for any loss or damage arising from or in connection with your use of a Foundry Coffee Gift Card where such loss or damage arises from any cause beyond our reasonable control. If we fail to comply with these Terms & Conditions for a reason within our reasonable control, we are responsible for loss or damage you suffer that is a foreseeable result of our breach or our negligence, but we are not responsible for any loss or damage that is not foreseeable. Loss or damage is foreseeable if it is an obvious consequence of our breach or if it was contemplated by you & us at the time we entered into these Terms & Conditions. Where any loss or damage arises from a cause within our control, our liability to you shall not exceed a sum equal to the balance on your Foundry Coffee Gift Card as at the date that such loss or damage occurs. This clause shall not exclude or limit any liability that cannot be excluded or limited by law.

9. Termination / Variation

We reserve the right to amend or waive any provision of these Terms & Conditions from time to time or to terminate the Foundry Coffee Gift Card service on reasonable notice. The Terms & Conditions applicable to the use of a Foundry Coffee Gift Card shall at any time be the terms & conditions published on our website &/or www.foundry.coffee & your continued use of a Foundry Coffee Gift Card shall constitute your acceptance of such terms & conditions.

10. General

These Terms & Conditions constitute the entire agreement & understanding between us & you with respect to your use of the Foundry Coffee Gift Cards.

If any provision of these Terms & Conditions are unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from these Terms & Conditions & shall not affect the validity & enforceability of any remaining provisions.

Any failure or delay by us in enforcing (in whole or in part) any provision of these Terms & Conditions will not be interpreted as a waiver of our rights or remedies.

We may transfer the benefit of these Terms & Conditions to any other company in the same group of companies as Foundry Coffee. If we assign the benefit of these Terms & Conditions, your rights will not be affected.

Foundry Coffee reserves the right to add to or waive these Terms & Conditions on reasonable notice for legal, security or regulatory reasons or to discontinue the Foundry Coffee Gift Card scheme at any time in the event of circumstances beyond its reasonable control. Customers will be notified in advance via in-store displays in the event of any such change.

11. Governing Law

These Terms & Conditions are governed by English law. These Terms & Conditions are only available in English. You agree, as we do, to submit to the non-exclusive jurisdiction of the English courts. If you live in Scotland you will also benefit from any mandatory provisions of Scottish law & can bring legal proceedings in respect of the Prize Draw & these terms & conditions in either the Scottish or the English courts.

13.  Additional Terms & Conditions which apply to Foundry Coffee Gift Cards purchased online

In addition to paragraphs 1-12 of these Terms & Conditions, this paragraph 13 also applies to purchase of Foundry Coffee Gift Cards through the website (https://giftcards.foundry.coffee).

a. Sales of Online Gift Cards through the Site are managed & fulfilled by a third party. The maximum value of Foundry Coffee Gift Cards that can be purchased in any one order is £300.

b. Online Foundry Coffee Gift Cards ordered through the Site shall either:

i) In the case of physical Online Foundry Coffee Gift Cards (“Physical Gift Cards”), be sent to the delivery address(es) stated on each individual order. Deliveries are normally dispatched within two working days unless a specified later delivery date is requested. Where possible Foundry Coffee will try to meet all delivery requirements but shall not be liable for any loss incurred either directly or indirectly by failure to meet the delivery date & time indicated at the time of order being placed. ‘Loss’ in this instance includes loss of profit, costs, damages, charges or other expenses; or

ii) In the case of email Online Gift Cards (“E-Gift Vouchers”) shall be dispatched by email to the designated email account as soon as payment for the Email Gift Card has been cleared.

It is your responsibility to ensure that the delivery email address or physical address entered is correct. Foundry Coffee cannot be responsible for the incorrect delivery of Online Foundry Coffee Gift Cards due to an error by you (such as, a mis-typed email address or physical address).

c. In the case of Physical Gift Cards, risk will pass to you upon delivery & title will pass upon receipt of payments in full. Foundry Coffee cannot be held responsible for lost, stolen or damaged Physical Foundry Coffee Gift Cards following delivery to the recipient. Foundry Coffee is not responsible for funds on the card used without your knowledge.

d. Online Foundry Coffee Gift Card quantities should be checked immediately by the recipient upon receipt (it is the purchaser’s obligation to ensure this is done if the recipient is different to the purchaser). Any discrepancies must be notified immediately (it is the purchaser’s obligation to ensure this is done). Foundry Coffee cannot be held responsible for shortage or loss of any Online Foundry Coffee Gift Cards not notified to Foundry Coffee within three days of delivery.

e. Cleared payment is required prior to the dispatch of orders. Payment is taken automatically at the time of purchase. Your credit/debit card statement will read “Foundry Coffee Gift Card”. Foundry Coffee reserves the right to decline any order without providing explanation. Foundry Coffee will not be given access to your credit/debit card details.

f. Online Foundry Coffee Gift Cards are only available for purchase in pounds sterling using a credit or debit card.

g. The re-sale of Online Foundry Coffee Gift Cards is strictly prohibited.

h. Foundry Coffee cannot be held responsible for Email Gift Cards that cannot be delivered due to the recipient's spam filters, firewalls, capacity of the mailbox, any other factors outside of Foundry Coffee’s reasonable control.

i. Foundry Coffee Gift Cards are exempt from Foundry Coffee’s refund policy except for Online Foundry Coffee Gift Cards. The purchaser of the Online Gift Card has the right to cancel the Online Foundry Coffee Gift Card within 14 working days of receipt provided the Online Foundry Coffee Gift Card has not been used. In case of cancellation, Foundry Coffee will endeavour to refund the amount of the gift card to the original payment method used during ordering within 30 days of cancellation.

The purchaser of the Online Gift Card must inform us of its intention to cancel the purchase within 14 days of the date the Online Gift Card is received by emailing Foundry Coffee at hello@foundry.coffee.

Please include a clear statement of the wish to cancel the purchase, provide evidence of proof of purchase, details of name, address, details of the order to cancel &, where provided to Foundry Coffee as part of an order, the purchaser’s phone number & email address.
